I. User Eligibility
Age and Legal Capacity
All users must be at least 18 years of age or the legal age in their respective country to participate in any of Trade Dynamics’ trading programs or use any of its platforms. Users affirm that they are fully able and competent to commit to the terms, conditions, obligations, affirmations, representations, and warranties set forth in these terms, and to abide by and comply with these terms.
Legal Compliance
Users affirm that their participation in Trade Dynamics’ trading programs does not violate any laws in their jurisdiction, including but not limited to restrictions concerning online trading and gaming. Trade Dynamics does not provide services to residents of the United States.
II. Risk Acknowledgment and Limitation of Liability
Risk Acknowledgment
Users acknowledge that trading involves significant risk and that there is a possibility of losing all funds deposited with Trade Dynamics. Users agree that all trades conducted through Trade Dynamics platform are at their own risk and they will not hold Trade Dynamics liable for any losses incurred.
Limitation of Liability
Trade Dynamics, its affiliates, employees, agents, and partners shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:
– The use or inability to use the platform or services.
– Unauthorized access to or alteration of user data.
– Actions or decisions taken based on information provided by the platform.
Indemnification
Users agree to indemnify, defend, and hold harmless Trade Dynamics, its affiliates, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with:
– Their use of the platform or services.
– Their violation of these terms or any applicable laws.
– Third-party claims resulting from their actions or inactions while using the platform.
III. Account Integrity and Accuracy
Account Integrity
Users are responsible for maintaining the confidentiality of their account information, including their password, and are responsible for all activities that occur under their account. Users agree to notify Trade Dynamics immediately of any unauthorized use of their account or any other breach of security.
Accuracy of Information
Users affirm that the information they provide to Trade Dynamics during the registration process and thereafter is accurate and true. Any false representation, including the provision of a fake or unauthorized name, is a violation of these terms of service. Users agree to promptly update their account information to ensure that it remains current, complete, and accurate.
Single Account Policy
Users are restricted to creating a single account on Trade Dynamics’ platform. Creating multiple accounts may lead to termination of all related accounts and forfeiture of any associated profits.
IV. User Conduct and Use of Service
Adherence to Ethical Trading
Traders must engage in ethical trading practices, avoiding any strategies or actions that exploit or manipulate the simulated trading environment. Any activities deemed to be in violation of Trade Dynamics’ trading guidelines will be subject to review and potential termination of service.
Respectful Interaction
Traders are expected to interact respectfully with Trade Dynamics staff, other traders, and any individuals or entities associated with Trade Dynamics. Any form of harassment, discrimination, or inappropriate behavior will not be tolerated and may result in immediate account termination.
Security and Account Integrity
Traders are responsible for maintaining the security of their account, including safeguarding login credentials and monitoring account activity. Any unauthorized or suspicious activity should be reported to Trade Dynamics immediately.
Compliance with Laws and Regulations
Traders must comply with all applicable laws and regulations related to trading and financial activities in their respective jurisdictions. Any illegal activities conducted through Trade Dynamics’ platform will result in immediate account termination and may be reported to relevant authorities.
V. Payment Details and Obligations
Payment Methods
Users agree to pay all applicable fees related to their use of Trade Dynamics’ services using accepted payment methods. By subscribing to Trade Dynamics’ services, users authorize Trade Dynamics to charge their provided payment methods for these subscription fees.
Payment Obligations
Users are responsible for all charges incurred under their account, whether made by the user or another person using their account. If payment for subscription fees is not received by Trade Dynamics from the payment method provided by the user, the user agrees to promptly pay all amounts due upon demand by Trade Dynamics.
Subscription Modifications and Price Changes
Users cannot modify their subscription settings, including upgrading or downgrading their subscription plan, through their account settings or by contacting Trade Dynamics’ support team. Trade Dynamics reserves the right to adjust pricing for its services or any components thereof at any time. Price changes will take effect following email notice to the users.
Refunds and Credits
Refunds or credits will be subject to the Refund Policy outlined below. Any refunds will be processed via the original payment method used by the user.
VI. Refund and Cancellation Policy
Eligibility for Refund
Refunds are granted on a case-by-case basis and can be requested via customer support within fourteen (7) business days of account purchase. A trader account must be active but never used for trading to be eligible for a refund.
Refund Request Procedure
Traders must submit a formal refund request by email within fourteen (7) days from the date of account purchase.
Refund Amount and Fees
Refunds will be equivalent to the amount paid, minus any fees that may be incurred, including non-recoverable technology and market data fees.
Non-Refundable Circumstances
Accounts that have been used for trading, including placing trades, opening positions, or utilizing market data, are not eligible for refunds under any circumstances.
VII. Termination of Service
Grounds for Termination
Trade Dynamics reserves the right to terminate service for any trader who violates the terms of service, engages in unethical or illegal activities, or disrupts the trading environment for others.
Notice of Termination
Traders will be notified of account termination via email, outlining the reasons for termination and any applicable next steps or appeals processes.
Consequences of Termination
Terminated traders will lose access to Trade Dynamics’ platforms and services, and any funds or balances in their account may be forfeited.
VIII. Intellectual Property
Users acknowledge that Trade Dynamics owns all legal right, title, and interest in and to the platform, including any intellectual property rights which subsist in the platform. Users agree not to infringe upon Trade Dynamics’ intellectual property rights and to utilize Trade Dynamics’ content and data solely for personal trading purposes.
IX. Communication and Privacy
Communication
Users consent to receive electronic communications from Trade Dynamics and agree that all agreements, notices, disclosures, and other communications that Trade Dynamics provides to them electronically satisfy any legal requirement that such communications be in writing.
Data Privacy and Protection
Trade Dynamics is committed to protecting traders’ data and privacy, adhering to applicable data protection laws and regulations. Traders’ personal and financial data will only be used to provide and improve Trade Dynamics’ services and will not be shared with unauthorized third parties.
X. Technology Usage
Users agree not to distribute, upload, or transmit any software or other computer files that contain a virus or other harmful component, or otherwise impair or damage Trade Dynamics’ platform or any connected network.
